Family Medical Leave Act
The Family Medical Leave Act guarantees employees working for medium sized to larger companies medical leave for their own and for their family member’s medical needs. The FMLA covers employees who have been employed at their job for at least one year and who work at a company that employs at least 50 employees within 75 miles of the employee’s workplace. If you have informed your employer that you require leave time for your medical needs or for a family member’s medical needs, or if you have put in for FMLA leave, the law offers you protection. Once you tell you employer that you need FMLA leave, the employer has an obligation to see to it that you get the paperwork needed to put in for leave. After your return from FMLA leave, the employer is required to place you back into the same or a comparable position to the position you held when you began your leave. If your employer did not or if it took adverse action because of your requesting or taking FMLA leave, you may have a claim under the FMLA.
